Shahabuddin, who is in Siwan jail, filed the petition to attend the Feb 16-26 session. In his plea filed Friday, he pointed towards the recent nod given to his party colleague and jailed MP Rajesh Ranjan Yadav alias Pappu Yadav.

Justice Ravinder Bhat asked the government counsel to reply to the petition by Feb 16.

Shahabuddin is in jail since May 2007 after a court convicted and sentenced him to life imprisonment in a kidnapping case. Besides, he has been convicted in five other criminal cases.

Earlier this week, a court granted permission to Pappu Yadav, lodged in Tihar jail for killing Marxist legislator Ajit Sarkar in 1998, to attend parliament session.
