The high court on November 23 deferred its decision on her plea, saying the Supreme Court judgment granting bail to five telecom executives earlier was "silent" on five public servants besides Kanimozhi.

The charge against them is criminal breach of trust, which is non-bailable. The five are former telecom secretary Siddharth Behura, filmmaker Karim Morani, DMK-run Kalaignar TV chief Sharad Kumar, director of Kusegaon Fruits and Vegetables Pvt Ltd Rajeev Agarwal and Asif Balwa of DB Realty.

A trial court on November 3 gave a shock to Kanimozhi and seven others when it denied them bail, saying aying the charges levelled against them were of "very serious nature."

While dismissing the bail application of Kanimozhi, daughter of former Tamil Nadu chief minister M Karunanidhi, the court said, "By no stretch of imagination she can be said to be suffering from any discrimination on ground of being a woman."
