According to the application, a copy of which is available with HT, the government has asked the court to “direct that its (government) policy — gas utilisation policy, which has fixed the price of KG-D6 gas at $4.20 or Rs 205 per unit — and the production sharing contract (with RIL for KG-D6 block) would have supremacy and would not be controlled by a private arrangement (the private MoU between the brothers) for sale or regulation of natural resource gas from the KG basin”.

The application also asks the court to set aside the June 15 judgment of the Bombay High Court in the Mukesh-Anil gas dispute. The judgment overruled the government’s gas utilisation policy and the PSC and directed RIL to sell gas to ADAG at $2.34 (Rs 114) per unit.

The government’s application will also clarify its stand on NTPC, which is presently fighting its battle against RIL in the Mumbai High Court. “We have told the court that NTPC’s case is different from that of RIL-RNRL,” the official said.

“The government will take a independent decision on NTPC as and when the Bombay High Court decides on it.”
