Additional Sessions Judge Rakesh Tiwari received the photocopy of an unsigned application, purportedly written by accused Surender alias Kalwa, through post seeking permission for his mercy killing.

When Kalwa was brought to the court and was asked about the application, he disowned it and the court dismissed it.

"Since it is not signed by the accused and he disowns the same and even as per the guidelines of the apex court, such applications are not maintainable in the circumstances of the present case," the court said.

Kalwa is facing trial for allegedly murdering a woman, her son and her grandson, with an intention to rob them in 2004.

He had earlier been diagnosed with cancer and had been undergoing treatment at AIIMS.
