A man has been sentenced to a year's imprisonment by a Delhi court for outraging the modesty of a woman. The woman was asleep in her home with her husband in a 'jhuggi' when the man entered her home and molested her.

Additional Sessions Judge (ASJ) Vijay Kumar Dahiya reduced the jail term of Ganju, the accused, from two years to one even as he upheld his conviction by the trial court. The court refused to let him off on probation, saying he did not deserve leniency as his offence "pertained to moral turpitude".

"In the present case, the accused tried to outrage the modesty of a lady in the dead of the night and fled away. The offence pertains to moral turpitude and does not call for any leniency," ASJ Dahiya said.

The order of the sessions court came on Ganju's appeal against the magisterial court's decision in January 2012. The sessions court had sentenced him to two years in jail.

Ganju was arrested by the police in May 2006 after the victim lodged a case, alleging that she was molested by the accused. The prosecution alleged that the complainant was asleep in her home with her husband, when she felt someone was groping her. Realising it was Ganju, she woke up and screamed for help, following which the accused fled, the prosecution added.

Ganju's counsel said the woman had not shouted for her husband to help her but rather for her mother-in-law. The ASJ, however, brushed aside the contention saying the accused had admitted of having been inside her jhuggi at the time of incident.
