Guardian Judge Gautam Manan refused the girl's custody to her biological parents saying the child cannot be made a scapegoat or an arm-twisting tool in the dispute.

The Delhi-based parents of the girl had moved the court saying they had given birth to her in December 2000 and one of their relative couple, who was childless at that time, had requested them to allow them to bring up the minor.

They said their relatives had promised them that they would return the child to them as and when desired.

The parents of the child said due to a property dispute between the two families, their relatives threatened them that in case they did not meet their demand, they would torture the girl. But the guardians of the girl contended that they were unnecessarily being harassed by the girl's biological parents so that they may return the child or pay Rs. 2 lakh as compensation.
