Rape victim faces criminal case for turning hostile

The court says it is expedient in the interest of justice to file complaint against her for giving wrong evidence.

A Delhi Court has ordered registration of complaint against an alleged rape victim for turning hostile in a case, leading to the acquittal of a 35-year-old accused.

"This court is of the opinion that it is expedient in the interest of justice to file a complaint against the woman for having given false evidence," Additional Sessions Judge Narinder Kumar said.

The court, in a recent order, exonerated Suresh, a resident of Tagore Garden Extension in West Delhi after noting that the 21-year-old victim had denied her own statement recorded by a magistrate.

"This court finds that she had actually turned volte-face and made false statements while saying she made statement before a metropolitan magistrate under pressure," the Judge said.

The woman, in her statement under Section 164 CrPC (Criminal Procedure Code) on May 2, 2005, had alleged that the accused had raped her for a period of two years with the promise of job and marriage.

She had to undergo abortion twice during this period, the woman alleged.

But during the trial, she turned hostile and alleged that her parents had pressurised her to sign a police complaint against the accused on April 26, 2005 and even subjected her to electric shock.

She also denied all allegations against the accused levelled in the complaint lodged with Rajouri Garden police station here.
