School fined for violating Education Act

The Delhi Commission for Protection for Child Rights (DCPCR) has imposed a fine of Rs 25, 000 on the Rajkiya Pratibha Vikas Vidyalayas (RPVV) schools for holding entrance tests on April 9, 2010 for students.

The tests violate Section 13 (1) of Right of Children to Free and Compulsory Education (RTE) Act, 2009.

The commission also took notice of Rs 25 being charged by the authorities as registration fee.

Section 13 (1) of the Right To Education Act says, “If any school or person subjects a child to a screening procedure, shall be punishable with fine which may extend to Rs 25,000 for the first contravention and Rs 50,000 for each subsequent contraventions.”

The DCPCR has communicated the decision to the principal secretary, education, director and deputy director of education, government of Delhi and member secretary, National Commission for Protection of Child Rights.

Sections 31 and 32 of the RTE Act 2009, empowers the commission to monitor the implementation of the act and to function as the appellate authority.
