NEET PG, UG Counselling 2021 LIVE: Supreme Court allows counselling to begin

Ministry of Health and Family Welfare has expressed his gratitude after Supreme Court's verdict on EWS quota for NEET PG Counselling 2021.

As counseling was delayed, the first year PG medical students could not be admitted which had a cascading effect on the medical workforce as first year PG resident doctors constitute 33% of the medical workforce.

After Supreme Court's verdict today, Medical Counselling Committee is expected to release counselling schedule for both undergraduate and postgraduate courses soon. The counselling session will be available on the official site of MCC on mcc.nic.in.

Supreme Court in today's verdict has allowed counseling for NEET PG, UG and has upheld the validity of 27% OBC and permitted 10% EWS under existing criteria. 

Federation of Resident Doctors' Association (FORDA) has welcomes Supreme Court's verdict on EWS and OBC quota for NEET PG, UG Counselling 2021. 

Supreme Court has permitted the 10% reservation for economically weaker section (EWS) among general category to be applied based on the criteria laid down in January 2019 for this year. 

The interim order was passed by Apex Court after the Centre sought an urgent hearing on the batch of petitions in view of the stir by resident doctors demanding counseling to be held at the earliest. 

Supreme Court has said that it will review the criteria for EWS reservation as laid own by a three-member Committee headed by former Finance Secretary Ajay Bhushan Pandey in the third week of March when the batch of petitions challenging the introduction of EWS quota in Neet-PG AIQ seats by a circular of July 29, 2021 will be heard.

The Apex Court in today's hearing has directed that for this year the criteria laid down in Jan 2019 for EWS quota will be followed. For the future years, the Court decided to examine validity of the EWS criteria as laid down by Pandey Committee and listed the batch of petitions for hearing in 3rd week of March.

Supreme Court in its verdict today has allowed counselling session to begin for both undergraduate and postgraduate courses for NEET. The apex court has upheld the 27 percent OBC quota. 

NEET PG Hearing will begin soon. The matter will be heard by a special bench led by Justice DY Chandrachud and Justice AS Bopanna.

On Thursday, January 6, 2022, a two-judge bench of Justices D Y Chandrachud and A S Bopanna concluded a hearing on the matter and reserved the verdict. 

The NEET PG counselling 2021 was scheduled to commence on October 25, but was deferred till further notice due to the intervention of the apex court.

Centre had told the apex court on Wednesday that it would not accept a position whereby those falling in the OBC or the EWS category, whether before or after the exercise of revisiting the criterion of ₹8 lakh annual income, are deprived of something that is legitimately due to them.

A bench of justices Dhananjaya Y Chandrachud and AS Bopanna, which heard the matter for two consecutive days, said, “In national interest, counselling has to begin” as it finished hearing the petitioners on their challenge to the July 29 order and the submissions by the Centre in support of the decision.

Supreme Court will pronounce order on EWS quota or OBC quota today, January 7, 2022. The Court has asked the petitioners to file a short note by today morning. 

Arguments have concluded. Order is reserved by Supreme Court for now. The Apex Court has asked the petitioners to file a short note of their reply by tomorrow morning. 

ASG KM Nataraj submits in Supreme Court that reservation in All India Quota seats can be made by an executive order or legislation. He also adds that petitioners are wrong in saying that reservation in AIQ can only be on basis of a judicial order. He completes his argument now. 

SG has completed his arguments. Now ASG KM Nataraj has begun arguments. He is also for the Central government. 

SG informs Supreme Court that the EWS category students who have registered themselves for the counseling round already have their certificates to show backwardness and are awaiting counseling subject to the final order to be passed by Court. He further states that prior judgments of SC prohibit reservation in super-specialty courses but that has no application to counseling for PG courses based on NEET exam. 

Federation of resident doctors tells Apex Court that there is an urgent need to hold counseling as it is affecting the doctor workforce in central government hospitals. They further inform the highest court that almost 33% workforce is lacking due to the counseling not being held as first-year students in PG courses have not joined. 

The petitioners have demanded that the counselling process should be held without giving effect to July 29 government order introducing OBC and EWS quota.
