Delhi HC rejects no-toll plea

The Delhi high court on Wednesday refused to hear a petition seeking removal of the toll plaza on the Delhi-Gurgaon Expressway. HT reports.

The Delhi high court on Wednesday refused to hear a petition seeking removal of the toll plaza on the Delhi-Gurgaon Expressway.

The court, however, said that the petitioner may become a party to a similar case pending in the Punjab and Haryana High Court between the expressway concessionaire and the city police.

A resident group, Toll Hatao Sangharsh Samiti, had filed the petition on the grounds that there was another toll plaza at Kherki Dhaula near to the Delhi-Gurgaon Expressway and both the tolls fall under the municipal limits of Gurgaon.

"We also pleaded that the toll operator had failed to ensure smooth traffic, leading to chaotic jams every day," said Jaswant Vats, the counsel for the petitioner.

Vats said the petitioner will soon move the Punjab and Haryana high court, although it had rejected a petition filed by the group earlier.

"The reason for our demand to remove tolls is different from the ongoing case between the concessionaire and the traffic police," said Dharam Sagar, a member of the Samiti. He said the group's demand is based on an audit report which claimed that the toll operator has already earned the stipulated revenue.
