AU, govt asked to file reply on delink issue

THE ALLAHABAD High Court has asked the Allahabad University authorities, Central Government and University Grants Commission to file a reply (counter affidavit) within six weeks in a writ petition challenging the decision of the Executive Council (EC) of Allahabad University (AU) to delink Kamla Nehru Post Graduate Institute of Medical Science (KNPGIMS) from Allahabad University.

THE ALLAHABAD High Court has asked the Allahabad University authorities, Central Government and University Grants Commission to file a reply (counter affidavit) within six weeks in a writ petition challenging the decision of the Executive Council (EC) of Allahabad University (AU) to delink Kamla Nehru Post Graduate Institute of Medical Science (KNPGIMS) from Allahabad University.

This order was passed by Justice VK Shukla on a writ petition filed by the Employees’ Association of Kamla Nehru PostGraduate Institute of Medical Science.

The petitioner had challenged the order dated May 23, 2006 passed by the Executive Council of Allahabad University on the ground that the Parliament had passed the Allahabad University Statute by which the Allahabad University was given a Central status. It has been provided in this Statute that KNPGIMS would be a part of the Allahabad University.

Therefore, the Executive Council of the Allahabad University had no power to take decision delinking the institute from the AU. Only the Parliament could amend the Statute.

On the other hand, the counsel for Allahabad University PS Baghel pointed out that the KNPGIMS was a trust and the stand taken by the Executive Council was correct. According to him, the Executive Council had the power to delink the institute from the AU.

Elaborating his stand, Baghel said a sub-committee under the chairmanship of vice-chancellor of AU was set up to consider this issue.

This sub-committee had submitted its report recommending delinking of KNPGIMS from AU. The Executive Council of AU on May 23, 2006 accepted this report and delinked the KNPGIMS from AU.

Regarding the power of executive council of AU, Baghel said the Executive Council had the power to amend the AU Statute and in exercise of that power this decision had been taken.
