DEMANDING IMMEDIATE election of the Allahabad University Students’ Union (AUSU), a section of the varsity students led by student leader Vijay Kumar Dwivedi gheraoed the chairman of the AU Board of Trustees Prof GK Rai on Thursday.
Prof Rai explained to the students that the Board of Trustees is committed to hold the elections and assured them there were no efforts to unnecessarily delay the polls from any side.
It is worth mentioning that Prof Rai had written a letter to the AU Vice-Chancellor Prof Rajen Harshe conveying the stand of the Board of Trustees, AU Union on the union election for the session 2006-07.
In the letter, Prof Rai said that the new constitution of the Allahabad University Union -2000 lays down under section 13 (a) that Election is to be conducted by the Board of Trustees with the help of the returning officer. “Under section 13 (b), the Board of Trustees is empowered to draw the election programme. The same shall be announced by the Board of Trustees not less than 5 days before the date for the issuance of the nomination forms,” the letter dated November 8 says.
Prof Rai has clarified that the term of the present union will end on December 13, 2006.
“In this connection it is pertinent to point that Supreme Court has given an interim order on September 22, 2006 laying down the condition under which union election will be conducted forthwith. The Board of Trustees met on October 11, 2006 and discussed the implication of the above order for the union election for the year 2006-07. It was resolved that expert legal opinion may be taken on the issue,” the letter adds.
It also informs the V-C that the unanimous opinion of the senior advocates of the Allahabad High Court is that the union election 2006-07 can not be conducted on the basis of old constitution. Necessary ordinances have to be framed by the university incorporating the recommendations of the Supreme Court.
“The Board of Trustees, therefore, resolved to postpone the matter till the delivery of the final judgement of the Supreme Court. The Board of Trustees will meet and chalk out the future course of action after studying the final awaited judgement of the Supreme Court,” it says.
The letter also makes it clear that the Board of Trustees is of the firm conviction that the students’ union is an integral part of the university and that the election must be held but in view of the interim order of the Supreme Court, the issue of election will be taken up after the receipt of the final judgement and also after framing of the new ordinances.
