Consumer Forum makes doctors pay

THE DISTRICT Consumer Forum (DCF) on Monday directed two doctors, Dr AK Srivastava and Dr AN Shukla, to pay a compensation of Rs 4 lakh to Ramdiwakar Panday, resident of Babu Purwa colony.

The reason: Panday’s son Manoj died due to carelessness of the two doctors. The forum said the amount should be paid to the complainant within two months from March 1, 2006. Panday filed a petition to the DCF, stating that the negligence of the two doctors led to the son’s death. Panday also levelled some charges against Dr Rajahs Verma of Shukla Ganj, Unnao and New India Insurance Company Limited, Afeem Kothi Branch.

Panday stated that his son Manoj (24), who was suffering from ear disease, was operated upon by Dr Srivastva at Kulwanti Nursing Home, Kakadev, on November 14, 2000. Dr AN Shukla and Dr Rajahs Verma were present as anaesthetic experts during the operation which took place about 4 pm. The doctors, after conducting the operation, had said that Manoj would gain consciousness after four hours.

Although the kin of the patient had waited for several hours, they did not get any positive response. At 2 am, Dr Srivastava came and told the patient’s relatives that his heart was not functioning and he needed ventilator which was not available at the nursing home.

The parents of Manoj were told to take him to Kanpur Medical Center(KMC) and seek the advice from other doctors for treatment. The patient was shifted to KMC, but instead of calling other specialist doctors, treatment was done by Dr Srivastva, Panday alleged. Majoj died at 6 am. Following his death, Panday filed a criminal case against the doctors under section 304 IPC at Kakadev police station.

The complainant, who stated that a sum of Rs 35,000 was spent on his son’s treatment, demanded Rs 4 lakh as compensation.

Taking note of all the evidence, the three-member DCF committee said that the death of the patient after 14 hours of the operation clearly indicated the doctors’ negligence caused the patient’s death. The DCF members also noticed that Dr Srivastva had not produced any pre-operation and post-operation check-up chart which is made on hourly basis.

Moreover, the patient was young and used to help his family. Therefore, his sudden death had put the family members in deep trouble. The committee members further stated that the complainant had every reason to get the compensation from Dr Srivastva and Dr Shukla.
