Court directs cop to surrender

THE ALLAHABAD High Court has disposed of a writ petition filed by one Sri Niwas Pathak, a sub-inspector of UP Police posted in NOIDA, and while vacating the interim order staying his arrest, directed him to surrender forthwith.

THE ALLAHABAD High Court has disposed of a writ petition filed by one Sri Niwas Pathak, a sub-inspector of UP Police posted in NOIDA, and while vacating the interim order staying his arrest, directed him to surrender forthwith.

This order was passed by a Division Bench comprising Justice Sushil Harkauli and Justice GP Srivastava, after hearing the counsel for the petitioner and Additional Government Advocate Neeraj Kanta Verma, who represented the state.

An FIR under sections 323 and 504 of Indian Penal Code, and section 7 of the Prevention of Corruption Act, was lodged against the petitioner for beating and abusing complainant Jitendra Tewari, a resident of NOIDA, and demanding illegal gratification from him.

The first informant alleged that the petitioner, by misusing his authority and uniform, called him to the police station and demanded money to hush up a matter. It was further alleged that the petitioner and constables abused the first informant and after beating him, challaned him under section 151 of the Criminal Procedure Code.

In order to save his life and prestige, Tewari paid part of the amount demanded. However, when more money was demanded, he contacted a TV news channel which laid a trap of sting operation in which the petitioner was caught red handed on the camera and the whole episode was televised.
