Delete all charges against Mulayam: HC tells Ajeya
THE ALLAHABAD High Court on Tuesday disposed of a writ petition filed by Ajeya Singh, son of former Prime Minister Vishwanath Pratap Singh, directing him to delete all allegations in the writ petition against Chief Minister Mulayam Singh Yadav. The court had further directed that the name of Mulayam Singh Yadav be immediately deleted from the array of the parties and the relief sought against him should also be deleted.

The court had further directed that the name of Mulayam Singh Yadav be immediately deleted from the array of the parties and the relief sought against him should also be deleted.
However, while passing this direction, a division bench comprising Justice Dr BS Chauhan and Justice Pankaj Mithal allowed the petitioner to move an application seeking security for his property, namely Atlantis Multiplex Pvt Ltd at MG Marg Civil Lines, Allahabad, before the district magistrate, Allahabad.
The advocate-general assured that in case any such application is moved, the DM shall consider and grant security of the property of the petitioner in accordance with law.
In the above case, state of UP and several authorities of UP had been arrayed as respondent no -l to 6. Mulayam Singh Yadav as respondent No- 7 and zila adhyaksha, Samajwadi Party, Allahabad, had been arrayed as respondent no. 8.
The petition was filed seeking relief to issue writ, order or direction in the nature of mandamus commanding and directing the respondents - State government and others (1 to 6) not to damage and take any coercive measures without permission of this court against the petitioners Atlantis Multiplex Pvt Ltd.
The court was further requested to direct the respondents to provide adequate security against the illegal acts of the respondents no. 7 and 8.
The preliminary objection taken by Advocate General SMA Kazmi assisted by chief standing counsel CB Yadav, was that there was neither any specific averments against Mulayam Singh Yadav nor any cause of action had been properly disclosed in the writ petition. Further, the petitioner had filed the petition on the basis of sheer political motive.
Taking serious note of the contention of the advocate-general, the court directed that the names of Mulayam Singh Yadav as well as zila adhyaksha, Samajwadi Party, Allahabad, should be deleted from the array of parties and such paragraphs which contained averments against Mulayam Singh Yadav, should also be deleted forthwith and the relief sought against him was also directed to be deleted from the petition.
However, the advocate-general assured the court that since the government was committed to provide protection to everyone, therefore, if the petitioner moved any application within five days, the same shall be considered by the district magistrate, and he shall provide proper security for the property of the petitioner in accordance with law.
With the aforenoted observations the petition was disposed of. The petitioner was represented by Samit Gopal.
