By doing so, the court set aside a Punjab Excise act which said men under 25 years and women could not be allowed as bartenders.

The court clarified that women should not be compelled to serve as bartenders.

The judgment was given by a division bench of justices Mukul Mudgal and H.R. Malhotra on a petition by the Hotel Association of India.
