When the appeal came up for hearing, Justice C R Kumaraswamy upheld the Shimoga JMFC order permitting the Criminal Investigation Department, investigating the case, to conduct the DNA test as it was necessary for investigation and dismissed the appeal made by Halappa's counsel Ravi B Naik.

The High Court had on Wednesday adjourned hearing of Halappa's bail application to two weeks.

Halappa's judicial custody has been extended to June 7.

Halappa had quit as Food and Civil Supplies Minister on May 2 in the wake of allegations of rape of his friend's wife last November in Shimoga.
