ON A contempt petition, the Allahabad High Court has issued notice to Excise Commissioner, UP Allahabad Gajendra Pal, District Excise Officer, Varanasi Prem Chandra Mishra and two others and has also directed them to appear before the court on April 28, , the next date fixed. It has been alleged in this contempt petition filed by Cantonment Board, Varanasi area through its counsel SD Dubey that in spite of a judgment given by a Division Bench of this court on March 9 .

It has been alleged in this contempt petition filed by Cantonment Board, Varanasi area through its counsel SD Dubey that in spite of a judgment given by a Division Bench of this court on March 9, the opposite parties are running liquor shops within the Cantonment Board area of Varanasi, even though no permission has been granted to them.
Passing this order, Justice DP Singh also directed them to file reply before the date fixed.
However, the court granted one more opportunity to the opposite parties to comply with this order.
It may be recalled that a Division Bench of this court had directed on March 9 that no person could sell liquor on Cantonment premises, even if the licence was provided by the district excise officer, without the permission of the Cantonment Board.
During the course of hearing of this contempt petition, SD Dubey, the counsel for Cantonment Board, Varanasi alleged that despite this final judgment, respondents- Bhanu Jaiswal and Vimal Kumar Goenka, in collusion with excise officials, were running foreign liquor shops in Cantonment Board area of Varanasi, which was clear violation of the High Court decision.
After hearing him, the court in its order observed, “ From perusal of the petition, a prima facie case is made out’’.
