HC seeks report from ADA, ANN

THE ALLAHABAD High Court has directed the Vice-Chairman of Allahabad Development Authority (ADA), Allahabad?s Nagar Ayukta and Principal Executive Officer of Avas Vikas Parishad to file their affidavits disclosing the position of encroachment of parks in the city of Allahabad unauthorisedly by individuals, government departments etc.

THE ALLAHABAD High Court has directed the Vice-Chairman of Allahabad Development Authority (ADA), Allahabad’s Nagar Ayukta and Principal Executive Officer of Avas Vikas Parishad to file their affidavits disclosing the position of encroachment of parks in the city of Allahabad unauthorisedly by individuals, government departments etc.

The court directed them to give the details of the ‘parks’ under their departments.

The court also directed them to disclose in their affidavits the situation of parks- in residential localities, colonies, their existence, maintenance and their restoration, if any, after verification of spot position. Passing these directives on PIL, a Division Bench comprising Justice AK Yog and Justice Prakash Krishna observed, “The parks in the city have to be maintained at any cost in future. List of parks and relevant information must be submitted in a tabulated chart attached to their affidavits. The court shall get position of parks verified through an independent agency, if so required’’.

The court also directed the ADA to remove encroachments of all nature from and around th historical PD Tandon Park, Civil Lines and ban forthwith the taxi stand and rickshaw stand on pathways and clear forthwith the land meant for road widening.

“Simultaneously, following removal of encroachments, the Nagar Nigam shall widen the roads to their maximum extent and ensure proper street lights, dividers and zebra strips on the crossing’’, the court directed.The court passed this order on a PIL (no-2547 of 2005) filed by Anand Mohan, a noted social worker of Allahabad.

The court also directed the ADA to submit a detailed report regarding other parks in the city on April 17, 2006, the next date fixed in this case. “ADA and Nagar Nigam, Allahabad will check position of parks in residential colonies and satisfy that ‘parks’ shown in the sanctioned plan are restored and maintained. Necessary action be taken forthwith and the above order be complied before the next date fixed.
