HC seeks to know status of case material

ON A contempt petition, alleging non-compliance of High Court order in MLA Krishnanand Rai murder case, the Allahabad High Court has granted time to CBI counsel to inquire from the CBI whether entire records relating to this case have been handed over to the CBI or not.

ON A contempt petition, alleging non-compliance of High Court order in MLA Krishnanand Rai murder case, the Allahabad High Court has granted time to CBI counsel to inquire from the CBI whether entire records relating to this case have been handed over to the CBI or not.

It was alleged in the contempt petition that despite the High Court order, the State government has yet not transferred murder case of MLA Krishnanand Rai to the CBI along with entire records.

While accepting the request of the CBI counsel asking for one week’s time to ascertain the actual position, Justice DP Singh directed to list this contempt petition on August 14, 2006 for next hearing.

Today, when the case was the taken up, an affidavit was filed before the court on behalf of the state government, annexing a copy of the notification dated July 27, 2006 by which the case has been transferred to the CBI.

However, the counsel for the applicant stated that the entire records have yet not been transferred by the State Government to the Central Bureau of Investigation.

To recall, Krishnanand Rai, the BJP MLA from Muhammadabad constituency of Ghazipur district, along with his seven aides, was murdered in the last week of November, 2005. Samajwadi Party MP Afzal Ansari and his brother Mukhtar Ansari, MLA from Mau, have been named as accused in the murder.

Election rivalry was alleged to be the reason behind the murder as Rai had defeated Afzal in the Assembly election of Muhammadabad assembly constituency of Ghazipur district.

At one stage, a division bench of this court had on May 23, 2006 directed the CBI to enquire the murder case.
