HC stays deputy jailor?s arrest

THE ALLAHABAD High Court has stayed the arrest of deputy jailor of District Jail, Fatehpur, KP Singh in connection with a murder case. Passing this order, a division bench comprising Justice RC Deepak and Justice MK Mittal fixed May 8, 2006, for next hearing and also directed the state counsel to file a reply in this case.

THE ALLAHABAD High Court has stayed the arrest of deputy jailor of District Jail, Fatehpur, KP Singh in connection with a murder case.

Passing this order, a division bench comprising Justice RC Deepak and Justice MK Mittal fixed May 8, 2006, for next hearing and also directed the state counsel to file a reply in this case. It was argued by the petitioner’s counsel that the petitioner is posted as deputy jailor in the district Jail, Fatehpur. Two accused named Mahraj Deen and Satish were confined in the said jail in connection with a murder case. On the recommendation of the jail doctor and CMO, deputy jailer (undertrials) permitted them to be sent in police custody to Swaroop Rani Nehru Hospital, Allahabad, for medical treatment. It is alleged that the above-named accused committed murder of the owner of a brick klin. In this incident, the accused Mahraj Deen too was killed.

The counsel for the petitioner Viresh Mishra assisted by Amarendra Kumar Singh said that the petitioner is not named in the FIR and he is not responsible for any such act of the accused, but the investigation officer of this case is raiding his house for his arrest. They also said that the petitioner is ready to co-operate with the investigation, therefore, some protection be provided to him. The court stayed the arrest of the petitioner till the date fixed, provided, he (petitioner) co-operates with the investigation.
