A DIVISION bench of the high court, comprising Justices Bhanwar Singh and JM Paliwal, stayed the arrest of Dr (Mrs) Suman Gupta and Dr Kamta Prasad as well as the investigations being made by the officials of the Economic Offences Wing (EOW) till further orders.
It was alleged that the doctors had obtained admission in MBBS and MS courses on the basis of forged caste certificates.
On the contrary, it was argued on behalf of the petitioners that the caste certificates in question had neither been challenged nor cancelled till date and still held good.
Hence no action could be taken against the petitioners on the basis of the certificates.
It was also argued that the case was being investigated by the EOW officials who had no authority to conduct investigation in such matters. The orders were passed accordingly.
Former advocate general Virendra Bhatia and Dr LP Misra, advocate, appeared on behalf of the petitioners.
Transfer petition dismissed
A TRANSFER petition moved by two persons accused of criminal conspiracy, murder and treason relating to attack on the makeshift Ayodhya temple in 2005, was dismissed by Justice Shailendra Saxena of the high court here on Friday for non-prosecution. The petition sought transfer of the case from Faizabad to any other district.
