Jal Nigam staff will retire at 60 years: HC

THE ALLAHABAD High Court on Tuesday directed that the engineers and other employees of the Uttar Pradesh Jal Nigam would be entitled to superannuation on attaining the age of 60 years.

THE ALLAHABAD High Court on Tuesday directed that the engineers and other employees of the Uttar Pradesh Jal Nigam would be entitled to superannuation on attaining the age of 60 years.

Passing this directive, a Division Bench, comprising Justice VM Sahai and Justice Sabhajeet Yadav, quashed the order (dated July 11, 2002) passed by the Jal Nigam retiring the petitioners (engineers) from service at the age of 58 years.

The Division Bench passed this judgement on a writ petition filed by Bihangesh Nandan Sharan and other assistant engineers and executive engineers of the Jal Nigam.

The court observed that the petitioners were entitled to continue in service on their respective posts till attaining the age of 60.

In case they were permitted to continue after attaining age of 58 years at the strength of interim order and had received salary, the respondents were directed to permit them to work on their respective posts till they attained the age of 60 and pay their salaries.

The Division Bench further directed that if any petitioner had not been permitted to continue in service in the absence of any interim order and had not been paid salary, the Uttar Pradesh Jal Nigam was directed to reinstate him on his post for the remaining period till he attained the age of 60 years and pay his salary along with the arrears.
