The court rejected the bail application with observation that "releasing the applicant on bail is not advisable at least till filing of the charge-sheet in the two criminal cases in which he is accused."

Sharma was booked under various sections of the IPC, the Information Technology Act and the MP Manayataprapt Pariksha Adhiniyam, 1937.

The state government counsel opposed the bail application with the argument that the role of the applicant in the commission of the two crimes is that of a racketeer and not of middleman or facilitator.
