Mukhtar challenges court order

MLA from Mau and accused in the murder case of BJP MLA Krishnanand Rai, Mukhtar Ansari, has challenged the order passed by the Chief Judicial Magistrate of Ghazipur for his voice test, in the high court. The Chief Judicial Magistrate directed that Mukhtar?s voice be recorded and tested in connection with Rai?s murder case. To recall, Rai and his seven aides were killed in Ghazipur district on November 29. Mukhtar and his brother have been named in the FIR as accused in the murder. Rai was MLA from Muhammadabad Assembly constituency of Ghazipur district.

The Chief Judicial Magistrate directed that Mukhtar’s voice be recorded and tested in connection with Rai’s murder case.

To recall, Rai and his seven aides were killed in Ghazipur district on November 29. Mukhtar and his brother have been named in the FIR as accused in the murder.

Rai was MLA from Muhammadabad Assembly constituency of Ghazipur district. Election rivalry and gang war were alleged to be the reasons behind his murder, as Rai had defeated Mukhtar’s brother in the Assembly election.

In his application filed under Section 482 (inherent powers of the High Court) of the Criminal Procedure Code, Mukhtar, through his counsel, contended that he was not involved in the murder.

Besides, there was no provision for recording and testing of voice under the Criminal Procedure Code. Therefore, the CJM’s order was illegal, he stated.

The application is likely to be taken up by the High Court on Monday.
