Maharashtra Control of Organised Crime Act (MCOCA) court on Wednesday granted a stay on execution of non-bailable warrant against gutkha baron Rasiklal Dhariwal.
The warrant was issued on February 27 against Dhariwal and another gutkha maker Jagdish Joshi under MCOCA for alleged links with underworld.
"The stay has been granted on the fact that when the warrants were asked for, the court was not informed of the fact that the proceedings in the case were stayed by the superior court," Dhariwal's lawyer R Shirodkar told reporters.
"We pointed to the court that the stay granted by the honourable High Court was still in operation. It seems that when CBI filed for non-bailable warrant, this fact was not informed to the court," he said.
"We approached the court after we learnt from media about the non-bailable warrant. We wanted to examine the documents on the basis of which CBI had sought the warrant," he said adding "we filed an application for an inspection."
