Pandey murder: HC reserves verdict on writ

THE ALLAHABAD High Court has reserved its verdict on a writ petition filed by JK Agrawal, managing director of Triveni Glass Factory, Iradatganj, Allahabad district, seeking stay of his arrest in connection with the murder of Amarendra Kumar Pandey, president of Triveni Sheet Glass Workers? Union. The petitioner had challenged the FIR dated March 24, lodged by Raja Prasad Pandey at Ghoorpur police station.

THE ALLAHABAD High Court has reserved its verdict on a writ petition filed by JK Agrawal, managing director of Triveni Glass Factory, Iradatganj, Allahabad district, seeking stay of his arrest in connection with the murder of Amarendra Kumar Pandey, president of Triveni Sheet Glass Workers’ Union.

The petitioner had challenged the FIR dated March 24, lodged by Raja Prasad Pandey at Ghoorpur police station. It was alleged in the FIR that JK Agrawal and others had threatened Amarendra Kumar Pandey to stop his trade union activities and ultimately finally got him eliminated on March 24.

The petitioner sought stay of his arrest and also a direction from the court for quashing the FIR.

The order was passed by a Division Bench comprising Justice RC Deepak and Justice RN Mishra. The petitioner’s counsel Satish Trivedi and others contended that there was no evidence against the petitioner to prove his involvement in Pandey’s murder. Opposing the petition, senior advocates Ravi Kiran Jain assisted by Nandita Adawal and Umesh Narain Sharma contended that there was sufficient evidence to prove the involvement of the petitioner. Additional Government Advocate Mewa Lal Shukla, while citing a Supreme Court case, said that courts should normally not interfere at the beginning of and during investigation.

Harbansh Singh and Himanshu Singh appeared on behalf of the caveator and opposed the petition.

CJM’s order stayed
THE ALLAHABAD High Court has stayed the operation of an order dated February 27, passed by Special Chief Judicial Magistrate, Kanpur Nagar, in a complaint case by which non-executive chairman of Tata Tele Services Ratan Tata was summoned to face the trial.

This order was passed by Justice VK Chaturvedi on a criminal revision application filed by Tata Tele Services Ltd, New Delhi, through its non-executive chairman Ratan Tata.

The court also issued notice to complainant JP Telecommunication, Kanpur Nagar, and directed the government counsel to file reply within six weeks.

According to the application, a complaint case was filed by JP Telecommunication, in which Ratan Tata was made an accused. In the complaint, it was alleged that the complainant company had been cheated by Tata Company to the tune of several lakhs of rupees. Appearing on behalf of the revisionist Tata, senior advocate of Supreme Court KTS Tulsi assisted by Imran Ullah, advocate, contended that even from perusal of the complaint, it was a case of civil liability. It was also contended that the complaint was contrary to the letter of intent issued by the revisionist Tata Company to the opposite party- JP Telecommunication appointing him franchisee.

Condolence
A FULL court condolence meeting was held to mourn the death of three lawyers Luxmi Kant Pathak, Sheetla Prasad Pandey and Dev Raj Singh in the court room of the Chief Justice.

The judges and lawyers present in the meeting observed two minutes’ silence as a mark of respect to the departed soul.

Later, the Allahabad High Court Bar Association (HCBA) also organised a condolence meeting to mourn the death of some lawyers.
