A bench headed by Justice Arijit Pasayat held that the action of the accused -- Sattan and Upendra -- fell under the category of "rarest of rare" cases warranting death sentence.

Though a sessions court had imposed death sentence on the accused, the Allahabhad High Court altered the sentence to life imprisonment, upon which the UP Government filed an appeal in the apex court.
