What are your priorities as the chairman of Bar Council of Uttar Pradesh ?
Recently, we have met the Chief Minister and requested him to accept our scheme of mediclaim, a medical insurance scheme, for the lawyers of the State.
Under the scheme the premium will be deposited by the State Government while lawyers will be given financial aid in case they fall ill. Besides, another proposal has been put forward that every lawyer should be given a stipend by the government from the date of his enrolment for five years. My priority would be to get these two schemes implemented as they would be of great help for the lawyers.
What action is proposed to be taken against the fake lawyers ?
We have asked the District Bar Associations to take action against the fake lawyers and also inform the Bar Council so that further action is taken.
Besides, it has been made mandatory that the lawyer will mention his enrolment number in every Vakalatnama, filed in a case. In addition to it, the recent decision of Allahabad High Court asking the district judges to maintain a register mentioning the name and other details of every practising lawyer, would be of great help in checking the entry of fake lawyers.
What action is proposed if a lawyer is found indulging in 'professional misconduct '?
The Bar Council statutes specifically provide that if the professional misconduct is proved, the licence of the lawyer concerned would be cancelled. Every year we take action against several lawyers in this regard after hearing both sides.
What steps the Bar Council proposes to take to check the frequent strikes by lawyers ?
Bar Council has already passed a resolution asking its members to resort to strike only in rarest of the rare cases, that too for one day as a 'token strike'.
They have been asked to immediately inform the Bar Council in this connection, so that their grievances could be solved at the earliest.
Can you give any example when the strike was called off due to Bar Council ?
Yes, the latest example is strike by the lawyers of Padrauna district. The Bar Council intervened and the matter was resolved amicably. The strike was called off . We hope that lawyers will follow the resolution of the Bar Council of UP in this regard.
