Tax recovery process stayed

THE INCOME Tax Commissioner (Administration) today stayed the tax recovery process initiated by the department against Satish Dayal Sharma, son of former President (Late) Shankar Dayal Sharma in January last to recover dues of Rs 1.29 crore. The recovery process has been stayed till May 14, 2006.

THE INCOME Tax Commissioner (Administration) today stayed the tax recovery process initiated by the department against Satish Dayal Sharma, son of former President (Late) Shankar Dayal Sharma in January last to recover dues of Rs 1.29 crore. The recovery process has been stayed till May 14, 2006.

Sharma filed a stay application before the Income Tax Commissioner (Administration) saying this matter is already pending before the Income Tax Appellate Authority, who would hear the case on May 14, 2006 so considering this fact the recovery process be stayed till the matter is heard.

Sharma’s counsels P R Mishra and Sanjay Mishra said the Income Tax officials erroneously issued the notice for recovery of tax for year 1994-95 to 1998-1999 ignoring the fact that the matter is already pending before the Income Tax Appellate Authority.
