The Indore bench of Madhya Pradesh high court on Wednesday granted three weeks' time to the state to file their reply during hearing on a PIL filed over the killing of an undertrial murder accused at MY Hospital on the intervening night of July 20 - 21.
Earlier, the court issued notices to chief secretary, director general of police (DGP), DG (Jail), health department, Indore collector and MY Hospital superintendent.
The PIL has been filed by advocate Manish Yadav, secretary of Lawyer for Justice Society. Advocate Yadav said division bench comprising Justice PK Jaiswal and Justice DK Paliwal responding to respondent's plea granted three weeks’ time to file their reply in the court. The date for next hearing in the case couldn't be fixed today, but probably it will be held in the next month.
Informing about the petition he filed, advocate Yadav said on intervening night of July 20 - 21, some masked assailants killed murder convict Ram Dayal, 25, while he was undergoing tumour treatment at the government Hospital on July 16 in ward number 17. Dayal was shot dead at point blank range.
"At the time of incident, jail guard Yashpal, who had brought the accused to the hospital from Indore central jail, was reportedly sitting outside the ward, exposing the state of security at the hospital," he said.
"It is the duty of police and jail officials to ensure safety of prisoners and undertrials even at the hospital, but they failed to deliver this." "In the petition, we have requested court to conduct probe into the matter to find out who was responsible and take criminal action if necessary," said Yadav. "We have also requested to provide compensation to the family of the deceased," Yadav added.
