An application was also moved by the petitioner before the Lucknow Bench of the Court pleading that witnesses in the case should not be harassed by the state machinery.

A Division Bench comprising Justice Abdul Mateen and Justice VK Dixit gave time to the Advocate General Jyotindra Misra to file objections in this regard.

Two counter-affidavits were filed on Tuesday by the Uttar Pradesh government and the state CB-CID which is, at present, probing the case.

On the intervening night of July 15-16, Joshi's house in Lucknow was set on fire. Congress leaders alleged the BSP was the behind the arson.
