The defence advocate said while directing that all accused be given a copy of Rai’s statement the Bombay high court had said “an accused person, especially one charged with a serious offence has a statutory right to be apprised of every material that will be used against him by the prosecution”.
In view of the observations of the court last week, Peter’s advocate Mihir Gheewala sought a copy of the statement of the witness whose name and identity has been protected, as the CBI had indicated threat to the person.
The statement was kept in a sealed envelope as the investigating agency has sought confidentiality. The court has sought CBI’s reply on the application.
Meanwhile, the court extended judicial custody of all three accused — Indrani, Peter and Sanjeev Khanna — till July 18. The court allowed Peter’s advocate to meet him in jail on May 8.
