HC judge’s appointment challenged

Fourteen years after Justice J.N. Patel was appointed as a high court judge, a practicing advocate and former sessions judge has moved the Bombay High Court challenging his appointment.

Fourteen years after Justice JN Patel was appointed as a high court judge, a practicing advocate and former sessions judge has moved the Bombay High Court challenging his appointment.

Practicing advocate and former sessions judge V.P. Patil has filed a petition in the HC alleging that Justice Patel did not complete 10 years as a judge in lower courts. Article 217 (2)(A) of the Constitution provides that a judge should have completed 10 years of service as a judge for being eligible to be elevated to the HC.

The petition is likely to come up for hearing next week.
