Kasab to reply to prosecution charges

All eyes are set on a special court housed in central prison at Arthur Road where the lone surviving Pakistani gunman Ajmal Kasab would give a statement tomorrow on evidence adduced against him by the prosecution for his alleged role in the 26/11 terror attacks.

All eyes are set on a special court housed in central prison at Arthur Road where the lone surviving Pakistani gunman Ajmal Kasab would give a statement tomorrow on evidence adduced against him by the prosecution for his alleged role in the 26/11 terror attacks.

Kasab would reply to questions put to him by judge M L Tahaliyani in regard to the evidence placed before the court,
special public prosecutor Ujjwal Nikam told PTI.

Under section 313(1)(b) of CrPC, the court is empowered to examine the accused generally on the case after the
prosecution has concluded adducing evidence against him.

Kasab can either reply to the questions or even refuse to answer them, but in the event of his refusal to make a
statement he shall not be liable to punishment. However, the court may consider his replies while giving verdict.

Kasab has made three confessions after his arrest. One was admission of guilt before police soon after his arrest,
the other confession was made before a Magistrate which is admissible as evidence and the third one was in the trial
court when the accused accepted his guilt partially.

It is to be seen whether Kasab would stick to any of these confessions or say something new when the court records
his version today.
