Nooria seeks bail from high court

Nooria Haveliwala (27), the UK-based beautician, who rammed her car into six people, killing two, in an inebriated state, has approached the Bombay High Court seeking bail.

Haveliwala, who on January 29 rammed her SUV at Princess Street in South Mumbai killing a constable on duty, has sought bail stating that the investigation in the matter is complete.

Her advocate Sayaji Nanagre said that she cannot be booked under section 304 (culpable homicide not amounting to murder) of Indian Penal Code. She can at the most be booked under section 304 (a) (death due to negligence).

Her bail application states that the entire incident was due to accident and collusion with a taxi at the signal and later the car overturned as she lost control and hence she cannot be charged for voluntarily causing grievous hurt to deter public servant from his duty.

Her application stated she would be available for trial and would not tamper with the evidence.

Justice D.G. Karnik has kept the next hearing after a week.
