BJYM vice-president booked for posting porn videos in WhatsApp group

A day after the senior vice-president of Haryana Pradesh Mahila Congress Committee, RanjeetaMehta,filed a police complaint against Amit Gupta, vice-president of Bharatiya Janta Yuva Morcha (BJYM) for sharing pornographic videos in a WhatsApp group, police booked Gupta on Friday.

Gupta is facing charges under Section 509 (word, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code and Section 67(A) of the Information Technology Act. The IT Act charge, if proven, entails a jail term up to five years, with fine, which may extend to ₹10 lakh, while the IPC charge may lead to jail term of one year, or with fine, or both.

In her police complaint, Mehta stated that she was a participant of a Whatsapp group – Panchkula Manthan — which had many senior politicians, bureaucrats and media persons as active members.

“I was shocked to see around 65 vulgar videos posted in the group on the intervening night of August 29 and 30. After enquiring, I learnt that these videos were posted by Amit Gupta, who runs a chemist shop in Sector 11, and is vice-president of district BJP Yuva Morcha. He claims to be the nephew of MLA Gian Chand Gupta,” she submitted in her complaint.

Inspector Arvind Kumar, station house officer, Sector 5 said, “We have registered a case against Amit Gupta. The cyber crime cell is investigating the videos.”

Officials said the location of the accused at the time of sharing of videos, his internet usage and other activities on the mobile phone will be investigated.

Accused steps down from party position

In a press statement later in the day, Panchkula BJP president Deepak Sharma condemned the incident. He said Gupta had tendered his resignation as the BJYM vice-president.

“Gupta claims that he was attending a wedding and had given his mobile phone to one of his friends, who accidentally posted the obscene videos in the WhatsApp group. He claims that he got to know about it only through a phone call by a friend,” Sharma said.

“As alleged by some opposition parties that he is nephew of MLA Gian Chand Gupta; such facts are not true. Amit Gupta does not have any relation with the MLA or any other party member or officer-bearer of the Bharatiya Janata Party (BJP). MLA’s name was included just to bring a bad name to the party,” Sharma claimed.

He said the matter had been forwarded to the BJP State Coordination Committee for action.
