In a relief to renowned artist Anjolie Ela Menon, the Punjab and Haryana High Court on Friday quashed Haryana government’s decision of acquiring her land in Ghatta village for constructing a road.
The state government had acquired the artist’s land measuring around 1.5 acres of land falling along a proposed 60-metre-wide road in Sector-58, Gurgaon through a notification issued on February 3, 2012. In March last year, the high court had ordered stay on the acquisition process.
Menon’s advocate ML Sareen had argued that the state had wrongly issued the notification under section 6 of the Land Acquisition Act, 1894. He said the notification under section 6 came almost four years after a notification under section 4 of the Act issued on June 24, 2008. The petitioner had also challenged a notification under section 9 dated March 29, 2012, issued by the government for acquisition of her land.
Menon also said that the sector roads were being developed on acquired land and a seasonal lake which cuts through ecologically-sensitive Aravalli forest without obtaining permission from the Haryana pollution control board, environment and other authorities.
Co-petitioner with Menon, Primila Lewis, had also challenged acquisition of her 0.5 acre land in the same village and she also got relief from the high court.
On August 10, 2011, the high court had disposed of a bunch of 70 petitions, including Menon’s, challenging the land acquisition process in Gurgaon, giving the petitioners the option of approaching the court again if they were not satisfied with the decision of a high-powered committee constituted by the state to hear the grievances of the petitioners.
The petitioners had challenged the entire land acquisition process initiated by the state government for developing residential sectors 58-63 and commercial sectors 65-67 in Gurgaon.
