HC stays SEC order on fresh panchayat poll

The Punjab and Haryana high court on Friday stayed a Punjab state election commission order of July 10 vide which the panchayat election at Jaur Singh Wala village in Patti tehsil of Tarn Taran district on July 3 was countermanded and a fresh re-poll ordered.

The Punjab and Haryana high court on Friday stayed a Punjab state election commission order of July 10 vide which the panchayat election at Jaur Singh Wala village in Patti tehsil of Tarn Taran district on July 3 was countermanded and a fresh re-poll ordered.

A bench headed by justice RK Jain, while hearing a petition filed by Sukhdev Singh, also issued notice of motion to the state government as well as the state election commission to file their replies by August 12.

Sukhdev Singh was declared the winner for the post of sarpanch of Jaur Singh Wala village after he defeated his nearest rival Paramjit Singh by 148 votes.

Appearing for the petitioner, advocate Harchand Singh Bath informed the court that after he was notified elected to the sarpanch's post, the election commissioner had passed an order on July 10 for the re-poll, which did not have the sanctity of law since nothing had been provided in this regard in the relevant Act.
