30% women’s reservation bill approved by Uttarakhand governor: Officials

The bill providing 30% reservation to women in the state has been approved by Uttarakhand Governor Lt Gen (Retd) Gurmit Singh, said officials.

Officials privy to the developments in the governor house said the bill providing 30% horizontal reservation to domiciled women citizens of the state has been approved by the governor.

During the winter session, Uttarakhand assembly on November 30 had passed the bill providing 30% horizontal reservation to domiciled women citizens of the state.

According to the Uttarakhand Public Services (Horizontal Reservation for Women) Bill 2022, direct recruitment in public services and posts, in the vacancies to be recruited, 20% horizontal reservation will be given till July 24, 2006 and 30% after that in favour of the women candidates permanently domiciled in Uttarakhand.

Elaborating on the need for reservation for women, the bill stated that “in order to ensure social justice, equality of opportunity, improvement in living standards, a bill is proposed to provide 30% horizontal reservation to the women of the Uttarakhand in state services”.

On October 12, the state cabinet had authorised chief minister Pushkar Singh Dhami for bringing an ordinance on the issue of women’s reservation in the state government jobs.

The move followed developments in the high court, where the women reservation was challenged.

On August 24, Uttarakhand high court had stayed the 2006 state government order regarding providing 30% reservation in state services to women having domicile of the state till further orders.

The petitioners had challenged the government order of July 24, 2006, which provided 30% reservation to women having domicile of the state.

In the court, Kartikeya Hari Gupta, counsel of the petitioners had argued that the state government had no power to provide domicile-based reservation as the Constitution of India allows reservation on the basis of domicile only by an act of parliament.

The 2006 state government order was in violation of Article 14, 16, 19 and 21 of the Constitution of India, he added.
