Court orders FIR against Gautam Budh Nagar police personnel over allegations of assault, CP orders inquiry

An FIR has been registered against four police personnel of Gauatm Budh Nagar and four private security guards of the group housing society in Greater Noida after a complainant moved the court alleging that he was wrongfully arrested by police officials and assaulted in February this year, officials aware of the matter said, adding that the move took place following an order from the district court in Surajpur.

The FIR has been lodged on orders of the local court under CrPC section 156(3), where a magistrate is empowered to take cognizance of an offence and order an investigation, officials aware of the matter said.
An FIR has been registered under Sections 323 (assault), 342 (illegal confinement) and 504 (intentional provocation to breach public peace) of the Indian Penal Code against eight people, of which two are identified- one police sub-inspector of the Dadri police station and one security in-charge of the group housing society.
The complainant, Shashank Singh (33) approached the court to order an FIR when an incident took place near Gaur Atulyam Society around 11 pm on February 21 when he was waiting for his friend Chetan Sharma. “I was waiting for my friend in my car outside the society when the society’s security manager reached there along with some security guards and started knocking at the window. My car was parked on the side of the road, and they all demanded that I remove it from there. I resisted saying it was not a no-parking area. The guards then forcefully took away the car keys and hurled abuse at me,” he alleged.
Singh, who works in a private company, claims to be suffering from blood cancer, further said that the guards soon called up the local police to the spot while he dialled emergency number 112 but did not get any response. He alleged that police colluded with the security guards to beat him up.
Following this, Gautam Budh Nagar police commissioner Laxmi Singh has ordered a departmental inquiry into the matter as well.
SM Khan, deputy commissioner of police (Greater Noida), said, “Singh was arrested under CrPC section 151 (arrest to prevent a cognizable offence without an order from a magistrate or a warrant) as he and his friend had created nuisance in the market after consuming alcohol that night. However, as per the orders of the court, an FIR has been registered against a sub-inspector of the Dadri police station and three other unidentified police officers, as well as a security in-charge of the society and three other unidentified security guards of the society. A departmental inquiry is also being done into the matter”.
