Plot allotment to Delhi man: Penal action ordered against G Noida authority CEO

The district consumer commission issued the order on July 31 after hearing a new appeal filed by Mahesh Mitra

The Gautam Budh Nagar district consumer commission has ordered penal action against the Greater Noida authority chief executive officer (CEO) for “non-compliance” with a previous order of the national commission in a case involving the authority’s failure to allot industrial plots.

The case involves the non-compliance with an order issued by the National Consumer Disputes Redressal Commission (NCDRC) on May 2, 2014, in response to a petition filed plea by Delhi resident Mahesh Mitra, who had failed to obtain an industrial plot allotted to him allegedly due to negligence of authority officials.

The district consumer commission president, Anil Kumar Pundir, and members Daya Shanker Pandey and Anju Sharma, issued the order on July 31 after hearing a new appeal filed by Mitra.

“The appeal is allowed. The impugned order dated 07-01-2023 is set aside. The matter is remanded to the district commission, which will proceed in accordance with the procedure contemplated under the code of criminal procedure for taking penal action against the appellants, who are the concerned officers of Greater Noida authority, for non- compliance of NCDRC’s order. We direct that a notice be issued to the CEO of Greater Noida authority under section 251 of the criminal procedure code for taking penal action against him for non-compliance of NCDRC’s order. Schedule disposal for August 17, 2023,” said the district consumer commission’s order.

The district consumer commission will now hear this case again on August 17, as the Greater Noida authority will also file a response to the case.

Mitra filed this new appeal with the district consumer commission after the Uttar Pradesh state consumer commission “set aside” on June 23 the district consumer commission’s January 7, 2023, order in this case, in which then Greater Noida authority CEO Ritu Maheshwari was given relief because she faced no action for non-compliance with previous orders.

On January 7, the Gautam Budh Nagar district dispute redressal commission imposed a ₹2,000 fine and one-month jail term on the Greater Noida Noida authority CEO, a post held at the time by Ritu Maheshwari.

Giving relief to Maheshwari, the UP consumer commission, in its order delivered by the UP consumer dispute redressal commission’s justice Ashok Kumar and member Vikas Saxena had said, “The appeal is allowed.”
