Greater Noida submits recall application against arrest order of CEO

Two days after the Gautam Budh Nagar district consumer dispute redressal commission issued an arrest order against the Greater Noida authority chief executive officer, a post currently held by Ritu Maheshwari, for not complying with the state consumer forum’s 2014 order, the authority on Monday filed a “recall plea” in order to stop the execution of the order, said officials.

The Gautam Budh Nagar district consumer dispute redressal commission, in its January 7 order, said it has found that the Greater Noida chief executive officer “guilty of delaying the execution of an order” and imposed a fine of ₹2,000 and one-month prison. However, the CEO has been given 15 days to comply with the forum’s directions; failing which the forum will direct the city police commissioner to implement the arrest order.
“We have filed a recall application before the consumer forum because the order delivered on January 7 has an error in it; it was delivered without considering the view of the Greater Noida authority. The authority had not disobeyed the consumer forum order because the chief executive officer in 2018, while complying with the order, offered the plot to petitioner and issued a provisional allotment letter. The then CEO in 2018 also submitted an affidavit in this regard. We have submitted the recall application so that the district court can take view of that old affidavit and issue a stay on the January 7 order,” said Prerna Sharma, additional chief executive officer, Greater Noida authority.
The authority in its application also mentioned that Maheshwari is the CEO of the Greater Noida authority since the past three months and the matter pertains to a state consumer dispute redressal commission’s order that was delivered in 2014, said officials. The authority has also argued in the application, which will be heard on January 11 that the state commission order had not specified any allotment rate at which the plot should be allotted thereby resulting in confusion on deciding the rate, said officials.
However, petitioner Mahesh Mitra accused the authority of “lying” and said he is yet to receive any allotment letter. “The Greater Noida authority is misleading the general public and lying to the commission because they never issued any allotment letter till date, and definitely not in 2018. We have submitted our objection to their claim that they obeyed the state commission order. The authority has been harassing me since 2000, flouting the law and making a mockery of the commission orders for past many years,” Mitra said.
