The SC-appointed monitoring panel made the recommendation on the ground that no building sanction plan for the hotel was approved by the New Delhi Municipal Corporation. The panel also said the hotel had not been issued a completion certificate. Senior counsel Mukul Rohtagi said the hotel opened in 1951 and was recognised under the Delhi Hotels Act. The first Master Plan for Delhi came in 1962. All commercial premises existing prior to that are protected under Section 14 of the Delhi Development Authority Act.

NDMC advocate Sanjiv Sen said the hotel belonged to the Land and Development Office of India and the NDMC would only act upon its request. Sen said the hotel had all the permissions from the civic body.

An advocate representing the amicus curiae told the court that there won’t be sealing till Tuesday.
