The order came on a public interest litigation based on a report in the Hindustan Times on April 13, ‘National shame in capital city’.

The report said that the village, which is a home to more than 3,000 people, does not have a school.

Advocate Ashok Agarwal, who filed the PIL on behalf of NGO Social Jurist, brought to the notice of the court that despite being sanctioned two years ago, the school has not come up in the village, resulting in local children going without education.

“The said inaction on the part of the government is in violation of right to education as guaranteed to the children under Articles 21 and 21-A of the Constitution of India and also in violation of Right of Children to Free and Compulsory Education Act, 2009,” argued Agarwal.

The news report said in the absence of a school, about 97% of the village population remained illiterate.

The only alternative available is a school in Uttar Pradesh which is 8km away.
