The bench headed by Justice Altamas Kabir refused to hear the petition of All India Lawyers’ Joint Action Committee and said the lawyers' body had no locus standi in the case as it was not a registered entity. The petitioner had questioned the procedure adopted by the investigating agency for holding polygraphic and narco-analysis tests on the suspects and the accused.

The advocate arguing for the petitioner said the agency had gone ahead and conducted the narco test on the suspects despite having the knowledge that its validity is under challenge before a Constitution Bench of the Supreme Court.
