An Afghan national, sentenced to nine months in jail for forging his passport to justify his overstay here, has been ordered by a city court to be deported to his country.

Additional sessions judge Pawan Kumar Jain ordered Aravinder Singh’s deportation after modifying his nine months’ jail sentence, awarded by a magisterial court, to the actual jail term of over eight months served by him during trial.

While modifying Singh’s sentence on an appeal by him against the magisterial court order, the court also imposed a fine of R15,000 on him. “The appellant was arrested on November 6, 1997, and has spent almost eight months in jail during the trial. It becomes clear that the appellant has faced the agony of trial for more than 13 years which is too long,” the ASJ said.
