The Delhi high court has restrained a private school in Bharatpur, Rajasthan, from the “illegal” use of the name Delhi Public School (DPS) Society. Sumit Saxena reports.
The Delhi high court has restrained a private school in Bharatpur, Rajasthan, from the “illegal” use of the name Delhi Public School (DPS) Society.

With the tag of DPS, the school authorities attracted around 1,000 students and employed scores of staff members.
Counsel for DPS, Puneet Mittal, contended that a phony trust called "Delhi Public School (DPS) Trust", was issuing illegal franchise of DPS to private educational institutes across the country.
According to the petition filed by DPS society in February 2010, they came across an advertisement in the name of DPS Bharatpur, which bore a logo and crest mark similar to their own logo and crest.
Moreover, the advertisement purported to state that some institution, which was shown as DPS TRUST, managed the said DPS Bharatpur.
Mittal told the court: “The DPS Bharatpur School has one Bhim Singh as chairman, who in collusion with other board members of DPS Trust, plagiarised the DPS mark and the word Delhi Public School; and have also dishonestly and fraudulently copied the logo and the crest.”
Justice VK Jain said: “The defendants (DPS Bharatpur school authorities) are hereby restrained till further orders from representing in any manner that they are connected with Delhi Public School Society or any other school being run by Delhi Public School Society.”
