However, a bench headed by Chief Justice K G Balakrishnan said the construction could be carried out on the condition that the architecture of the monument is not affected.
Victoria Memorial authorities had moved the apex court seeking to modify the Calcutta High Court order disallowing any new structure.
The authorities had submitted that a new administrative block was required to replace the crumbling structure.
They had submitted that the National Institute of Design and the Centre approved the plan.
The Calcutta High Court on September 28, 2007 had disallowed any new construction activity in the precincts of the Victoria Memorial.
