SC declines to stay Orissa HC order on annulling election
The Supreme Court today refused to stay the Orissa High Court decision annulling the election of independent MLA Ramesh Rout from Athagarh assembly seat in the state but restrained the Election Commission to issue notification for fresh polls.
The Supreme Court today refused to stay the Orissa High Court decision annulling the election of independent MLA Ramesh Rout from Athagarh assembly seat in the state but restrained the Election Commission to issue notification for fresh polls.
A bench comprising J M Panchal and Justice H L Dattu asked Election Commission, not to take such a decision till July 19 when the matter would be taken up for further hearing.
The court passed the order on an appeal filed by Rout challenging the High Court's order which had on June 23 declared his election null and void.
The High Court had also directed Election Commission to conduct fresh polls in Athagarh assembly segment in Cuttack district.
The Court had also rejected Rout's plea for permission to attend the assembly till the end of the monsoon session. Orissa assembly, after the court's verdict, cancelled the membership of Rout.
